Terms of Service
By selecting the checkbox provided when registering for membership, you signify that you agree to these Terms of Service, hereafter called "Terms". To become a member, you must be at least 18 years of age, be a business owner, employed and authorized by a business, or acting on behalf of, in addition to being authorized by a business that has done business with the customers you review. Membership enables you to post reviews on what took place during a transaction with a specific customer (name) and/or address, and/or phone number, and/or email address, in addition to the customer's behavior during the transaction. You agree that your entries reflect your subjective opinion concerning the customer's behavior and what transpired during a single transaction. You also agree that all information that you post is truthful and accurate. In addition, you understand that we have a zero-tolerance policy on fake posts.
Use of Service and Information
Use of this Service beyond the scope of authorized access granted to you by this agreement immediately terminates said permission or license. In order to collect, aggregate, copy, duplicate, display or make derivative use of this Service or any Content made available via this Service for other purposes (including commercial purposes) not stated herein, you must first obtain a license by emailing support@patroncheck.com. PatronCheck.com is not a consumer reporting agency as defined by the guidelines of the Fair Credit Reporting Act (FCRA). When performing searches, you agree that you will not use the information provided for decisions about employment, insurance, tenant screening, consumer credit or any other purpose requiring Fair Credit Reporting Act (FCRA) compliance.
Disclaimer of Warranty
PatronCheck.com provides service on an "as is" basis and grants no warranties of any kind, express, implied, statutory, in connection with PatronCheck.com, the accuracy of reviews posted, or in connection with any communication with PatronCheck.com customer support representatives, or otherwise with respect to PatronCheck.com. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that PatronCheck.com's connection to the internet will be uninterrupted, always available, or error-free, or will meet your requirements.
General Provisions
We grant you a limited, revocable, nonexclusive license to access this Service. You agree that Arkansas law (regardless of conflicts of law principles) shall govern this Agreement, that any dispute arising out of or relating to this Agreement shall be subject to the exclusive venue of the federal and state courts in the State of Arkansas, and that you submit to the exclusive jurisdiction of the federal and state courts in the State of Arkansas in connection with PatronCheck.com or this Agreement. This Agreement, accepted upon registering for membership, contains the entire agreement regarding the use of PatronCheck.com. Unless otherwise explicitly stated, the Terms will survive termination of your registration with PatronCheck.com. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. We reserve the right to immediately suspend or terminate your membership, without notice, for any reason, including, but not limited to, any breach of this Agreement.
Limitation of Liability
PatronCheck.com acts as an "interactive computer service" and is not responsible for content created by third party users, as set forth by Section 230 of the Communications Decency Act of 1996. Even though the PatronCheck.com staff vets all reviews and removes or alters content that could be considered as defamatory, such as removal of derogatory names directed at the customer, in addition to substituting the word "is" (present tense) with the word "was" (past tense) in instances of when a PatronCheck.com member is describing the customer's overall behavior displayed during a transaction, in no event will PatronCheck.com be liable: (i) to you for any incidental, consequential, or indirect damages arising out of the use of or inability to use PatronCheck.com, even if PatronCheck.com agents or representatives know or have been advised of the possibility of such damages or: (ii) to any person other than you the member. In addition, we disclaim all liability, regardless of the form of action, for the acts or omissions of other members or users including, but not limited to, unauthorized users of PatronCheck.com.
Indemnity
You will defend, indemnify, and hold harmless PatronCheck.com, its parent company, officers, directors, employees, agents and third parties, for any losses, costs, claims, actions, judgments, liabilities and expenses (including attorneys' fees) relating to or arising out of your use of PatronCheck.com, including, but not limited to, any breach by you of the terms of this Agreement.
